GENERAL PROVISIONS

My-initials.com, the electronic webshop of the VOF FANSS, a general partnership with registered office at Latemstraat 7, 9830 Sint-Martens-Latem, Belgium, VAT BE0670.856.156, (hereinafter “My-initials.com”) offers its customers the possibility to purchase clothing online.

These General terms and Conditions (‘Terms and Conditions’) apply to all items in the webshop range and any purchase placed by the customer with My-initials.com.

The customer accepts that these Terms and Conditions shall apply exclusively, to the exclusion of his own general or specific (purchase) conditions, even if they stipulate that they shall apply exclusively. If the customer does not agree with these Terms and Conditions, then it is recommended not to make any purchases on My-initials.com.

PRICE

All prices mentioned are always inclusive of VAT and all other taxes to be borne by the customer. If transport, reservation or administrative costs are charged, this will be stated separately.

The statement of price refers exclusively to the articles as described verbatim. The accompanying photo is intended for decorative purposes and may contain elements or articles that are not included in the price.

OFFER

Each offer is open to all customers worldwide…

The articles are for normal use only.

Despite the fact that the webshop and the website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, or contains material errors, or is not up to date.

If you have specific questions about e.g. sizes, colour, availability, delivery time or delivery method, please contact our customer service in advance (see article 13).

My-initials.com is only bound by an obligation of means with regard to the correctness, updating or completeness of the information provided. My-initials.com is under no circumstances liable in case of material errors, typesetting or printing errors.

The offer is valid as long as stock last and can be adjusted or withdrawn at any time by My-initials.com.

My-initials.com is entitled – without giving reasons – to refuse orders, to adjust delivery times, to split deliveries or to attach other conditions to the delivery.

ONLINE PURCHASES

The customer has the possibility to purchase the articles from the My-initials.com range online.

The purchase is made when the customer receives a confirmation email from My-initials.com. the items will be delivered to the customer’s home on the delivery date indicated in the confirmation email.

The customer has the choice between the following payment methods :

• by credit card
• by debit card
• by Paypal

RETENTION OF TITLE

The delivered items remain the exclusive property of My-initials.com until full payment by the customer.

However, the risk of loss or damage shall pass to the customer as from delivery. The customer undertakes, if necessary, to inform third parties of the retention of title of My-initials.com, e.g. to anyone who would seize items that have not yet been paid for in full.

SANCTIES FOR NON-PAYMENT

Without prejudice to the exercise of other rights available to My-initials.com, in the event of non-payment or late payment from the date of default, the customer shall automatically and without formal notice owe interest of 10% per annum on the unpaid amount. In addition, the customer shall automatically and without formal notice owe a fixed indemnity of 10% on the amount in question, with a minimum of EUR 25 per invoice.

Without prejudice to the above, My-initials.com reserves the right to take back items that have not (fully) been paid for.

COMPLAINTS

Any visible damage and/or qualitative shortcoming of an article or other shortcoming in the delivery, must be reported immediately, otherwise any right to compensation lapses.

WARRANTY

The legal warranty applies.

RIGHT OF REVOCATION

The consumer has the right to notify My-initials.com that he renounces the purchase without penalty and without giving a reason within 14 days from the day following the delivery of the product.

Customers who wish to exercise the right of withdrawal must contact My-initials.com customer service within 14 days of delivery and return the goods to My-initials.com within 14 days of delivery of the goods. Tou can print out the form via the link below :

Only items that are in their original and undamaged packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.

As soon as we have received the items back, we will refund the amount of clothing returned.

Won’t be taken back under any circumstances :

• used, soiled, damaged or incomplete articles
• items from which the label has been removed
• articles containing perfumes or other fragrances
• articles made to measure for the customer
• articles which, by their nature, cannot be returned

PRIVACY

My-initials.com undertakes to use your data only for the execution of the agreement entered into by you through your order and to send you information from us without obligation. If you would also like to receive information via email, please also provide your email address.

We treat your data as confidential information and will never pass it on, rent or sell it to third parties. You can at any time request, correct, amend or delete the information we hold about you on My-initials.com’s customer list and you can refuse to allow My-initials.com to use your information to send you information. Simply request it in writing to the address below :

The customer is responsible for keeping his log-in data confidential and the use of his password. Your password is stored in encrypted form, so My-initials.com has no access to your password.

My-initials.com strictly respects the Belgian law of 8 December 1992 relating to the protection of privacy in the processing of personal data. Through your user profile you have access to all your data available on My-initials.com,and you can consult, modify or delete it at any time.

My-initials.com uses cookies.Cookies consist of a standard internet technology that allows certain information to be stored and accessed on the user’s system. INFRINGEMENT OF VALIDITY – NON RENUNCIATION

If any provision of these Terms and Conditions is declared invalid, unlawful or void, this shall in no way affect the validity, legality and applicability of the other provisions.

My-initial.com’s failure at any time to enforce any of the rights listed in these Terms and Conditions, or to exercise any right hereunder, shall not be construed as a waiver of such provision and shall not affect the validity of those rights.

My-initials.com may change these Terms at any time without notice. Any purchase made after the change will constitute customer acceptance of these new Terms and Conditions.

PROVIDE

The customer accepts that electronic communications and backups may serve as evidence.

APPLICABLE LAW – COMPETENT COURT

Belgian law applies, with the exception of the provisions of private international law on applicable law and of the Rome I Regulation on contracts for the international sale of goods. In the event of any disputes, the courts of Ghent shall have exclusive jurisdiction.

INTELLECTUAL PROPERTY RIGHTS

The entire My-initials.com website including text, photographs, images, moving images, sounds, illustrations and software is our property or the property of related companies, licensees and/or content providers. These are protected by copyright, trademark law, and all other forms of intellectual property rights. They may only be used with the permission of My-initials.com.

LIMITED RESPONSIBILITY

In no event shall we be liable for any viruses or damage to your computer, telecommunications equipment or other property as a result of visiting or using this website, or downloading any material from this  website.
